MegaFest Challenge Contest Rules
1. Sponsorship and Eligibility
This contest is sponsored by The Potter’s House of Dallas, Inc. at 6777 West Kiest Boulevard Dallas, Texas 75236 (“Potter’s House”). There is no purchase necessary to enter or win. This contest is open to legal residents of the United States who are eighteen (18) years or older at the time of entry; however, the contest is void where otherwise prohibited or restricted by law. Employees of Potter’s House, its affiliates, licensees, franchisees, advertising and promotional agencies and the immediate family members of each are not eligible. Texas law shall govern this contest. Void where prohibited.
2. Qualification Period
The qualification period for the contest begins at 12:01 AM (CST) on March 1st, 2017 and ends at 11:59 PM (CST) on May 31st, 2017.
3. Entry Procedures
To enter the contest, you must submit an audiovisual file in a permitted file format showing the person(s) performing that you wish to submit for purposes of the contest at mega-fest.org. Please follow all instructions found at the Site. Entrants under age 18 (minors) need parental permission to enter the contest. If minors are working as a team, the parents for each member of the team must complete give permission for the entry to be valid. The Entrant should be able to provide on request all appropriate clearances, permissions and releases for the video submission, including releases from the submitting Entrant and any third parties appearing in the submission. Incomplete, corrupted, untimely, or unintelligible entries will be disqualified. Sponsor reserves the right to determine in its sole discretion which entries have satisfied the entry requirements.
Videos must NOT:
- Exceed 2 minutes in play time;
- Contain material which is (or promotes activities which are) sexually explicit, obscene, pornographic, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, harassing or inconsistent in any other way with the religious beliefs of Potter’s House;
- Include mention or performance of any copyrighted media production including but not limited to music, films, books, television programming, etc., or identifying descriptions of any media property.
- Contain material that violates or infringes another’s rights, including but not limited to material that violates privacy, publicity or intellectual property rights, or that constitutes copyright infringement. Without limiting the foregoing, video submissions must not include third party trademarks, logos, insignia, location signage, photographs, artwork, or sculptures.
- Include third parties, including but not limited to minors, celebrities and friends who have not expressly authorized entrants to display their image, likeness or voice in any submitted video or otherwise use such image, likeness or voice in accordance with these rules.
By entering, each entrant represents and warrants that his or her entry (and Sponsor’s and its designees’ use thereof) does not and will not defame or otherwise violate the rights of any third party and does not and will not violate any federal, state, or local laws or ordinances. Entrant further represents and warrants that he or she has secured the requisite consent from any third party referenced or appearing in their entries. To the extent that anyone under the age of 18 appears in a video, entrant represents and warrants that the minor’s parents consented to the minor’s appearance in the video and the public display of the video by Potter’s House. Sponsor reserves the right in its sole discretion to disqualify any entry that it believes violates any of the Entry Procedures, does not otherwise comply with these rules, or that is not consistent with the spirit and theme of the contest.
4. Duties of Participants; Limitation of Liability
By entering, participants agree to be bound by these rules and the decisions of Potter’s House which shall be final. All federal, state, and local laws apply. Potter’s House and the employees, officers, directors, shareholders, agents, and representatives of Potter’s House, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Potter’s House that may cause the contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the contest; or (vi) any printing or typographical errors in any materials associated with the contest.
If for any reason, the contest is not capable of proceeding as planned, including without limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Potter’s House which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Potter’s House reserves the right at its sole discretion to cancel, termination, modify or suspend the contest.
5. Violation of Contest Rules
Potter’s House reserves the right to disqualify any participant or winner who, in its sole suspicion, tampers with the entry process, intentionally submits more than a single entry, violates these rules or the Site Terms and Conditions, or acts in an unsportsmanlike or disruptive manner.
6. Selection of Winners; Chances of Winning
Prizes will be awarded by and in the sole discretion of Potter’s House from among all eligible entries received. Potter’s House will submit entries to its social media users for a vote in a form and format to be determined in the sole discretion of the Sponsor. However, Potter’s House reserves the right to select any winner or no winner at all, including but not limited to, overriding any popular vote of Potter’s House social media users in its sole discretion. Odds of winning depend on the total number of entries received. Potter’s House reserves the right to award as few or as many awards as it deems fit in its sole discretion.
7. Description of Prizes
Each prize shall consist of an opportunity to perform on stage at MegaFest 2017, concierge level registration at MegaFest 2017, airfare discount for travel, and preferred seating for certain MegaFest 2017 sessions. Travel expected to occur between June 27th, 2017 and July 4th, 2017. Exact travel dates to be determined/communicated at a later date, by Sponsor, in Sponsor’s sole discretion. Travel and events are at the Sponsor’s discretion and subject to availability and change, and restrictions may apply. Winner must travel on the same itinerary and on the dates specified by Sponsor to qualify for any discount. Winner must comply with all travel requirements, which may include, without limitation, presenting necessary identification (i.e. driver’s license or passport) at the time of travel. Flight schedules are subject to change without notice. Any costs incurred due to changes to the original itinerary are solely the winner’s responsibility. Any additional ground transportation, lodging, trip cancellation insurance, personal purchases and all other expenses not specified herein are solely the winner’s responsibility. Approximate Retail Value of all prizes is no more than $800. Actual value of travel discount depends on city, day, and time of departure. The difference between any stated value and actual value will not be awarded. If winner cannot accept prize as specified, prize will be forfeited and awarded to an alternate winner (time permitting), in Sponsor’s sole discretion.
8. Notification of Winners; Substitution of Prizes
Winners will be notified by electronic mail. If any winner does not respond to email notification within three days of its transmission, or should the email be returned as undeliverable after two attempts, the prize will be forfeited and an alternate will be selected. Winners may not substitute or transfer prizes. Prizes are not redeemable for cash. All taxes on prize are winners’ responsibility. Limit: one prize per household. Sponsor is not responsible for any circumstance outside of Sponsor’s control which may result in potential winner not receiving initial prize notification.
9. Permissions and Ownership of Submissions
Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns and likenesses for online posting, and/or any advertising and publicity without additional compensation. Winners may also be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement, as conditions of receiving a prize. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of a prize.
As consideration for Potter’s House considering and reviewing entrants’ submissions, entrants hereby grant to Potter’s House a non-exclusive, worldwide, perpetual, assignable, royalty-free license to publish, reproduce, distribute, display, perform, create derivative works, transmit or disseminate the submission in all media or platforms whether now known or hereafter invented. Entrant also waives any and all moral rights in the submission with respect to any use by Potter’s House, its affiliates, sublicensees, or assigns. Sponsor and its designees shall have the perpetual, worldwide right to publish and use the entries in any way, and in any media for trade, advertising, promotional, and/or other purposes as Sponsor and/or its designees may determine without further consideration to entrant or any third party.
